Comment by the Information and Press Department of the Russian Ministry of Foreign Affairs regarding the Crimean law-enforcement agencies’ investigation activities in the Central Office of the Crimean Tatars’ Mejlis

On 16 September, the law-enforcement agencies of the Republic of Crimea, acting in accordance with the ruling of the Tsentralny District Court of Simferopol, conducted an investigation as stipulated by the laws of the Russian Federation at 2 Shmidta Street in Simferopol, where the Central Office of the Crimean Tatars’ Mejlis and the Crimea charitable foundation are located. They seized several hard disc drives, extremist literature, documents and firearms (the news has been reported by the Crimean and international media).

The search was conducted due to repeated violations of Russian law by the above organisations.

According to Protocol No. 1 of the constituent conference of the Crimea charitable foundation of 9 May 2002, the only founder of that organisation is a citizen of Ukraine (Mustafa Dzhemilev). According to Clause 1 of Article 15 of the Law of the Russian Federation No 7-FZ On Non-Profit Organisations, dated 12 January 1996, NPOs cannot be founded by a foreign citizen or stateless person whose stay (residence) in the Russian Federation has been declared undesirable in accordance with the legally established procedure.

The Prosecutor’s Office of the Republic of Crimea adopted Ruling No. 140/ZKS/13-108 of 19 April 2014 restricting Mr Dzhemilev’s stay in the Russian Federation. The ruling is effective for five years.

It has also been established that the Crimea charitable foundation, whose registered seat is 40 Zhidkova Street in Simferopol, Republic of Crimea, on 21 March 2014 has moved to and operated at 2 Shmidta Street in Simferopol, Republic of Crimea, in violation of the provisions listed in Article 5, Clause 1, Subclause C of the Law of the Russian Federation No 129-FZ On the State Registration of Legal Entities and Sole Proprietors, dated 8 August 2001.

While reaffirming our respect and support for ethnic organisations, we at the same time urge them to strictly comply with Russian legislation. All are equal before the law in the Russian Federation without any exceptions.
